Generally, a license is a permission to make use of another person’s property. In property law it may grant access to or allow the usage of foreign property. This property may be tangible, intangible, or of the intellectual kind, the latter being the most relevant in general license law.
A license agreement is a contractual agreement between the licensor, the owner of the property, and the licensee. The licensee is granted the right of use of the property, usually in exchange for a consideration, the so-called license fee. This is beneficial for both parties, as the licensor remains the owner of the property, while the licensee may still be granted permission to make use of it for his own purposes, possibly for lower costs than those of having to acquire the property, possibly because the licensor would not have been willing to sell.
There is no particular legal regulation for license law. Instead an independent legal framework exists for the respective special cases, such as trademark law or copyright law. Due to the contractual nature of a license, general contract law unsurprisingly also plays a role.
